CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

By ordering electronically through the website you are using, you are deemed to have accepted the pre-information form and distance sales contract provided to you.

Buyers are subject to the provisions of Law No. 6502 on the Protection of the Consumer and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other relevant laws in force regarding the sale and delivery of the product they have purchased.

Buyers will bear the shipping costs associated with the product shipment.

Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within a legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

The purchased product must be delivered in full and in compliance with the specified qualifications in the order, along with any warranty certificates, user manuals, and other documents if available.

In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of becoming aware of this situation. The total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

If the buyer does not pay the purchase price of the product or cancels it in the bank records, the seller's obligation to deliver the product ends.

TRANSACTIONS MADE WITH UNAUTHORIZED USE OF CREDIT CARDS:

If it is determined that the credit card used for payment has been used by unauthorized persons after the product has been delivered and the price of the product sold is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days at the expense of the seller.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE SPECIFIED PERIOD DUE TO UNFORESEEN REASONS:

If unforeseen force majeure events occur that prevent the seller from delivering the product within the specified period, the situation will be notified to the Buyer. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, the amount will be refunded within 14 days from the cancellation. If the payment was made by credit card and cancelled, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the Buyer's account.

THE BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer shall inspect the goods/services subject to the contract before receiving delivery; damaged or defective goods/services such as dented, broken, torn packaging, etc., will not be accepted from the cargo company. The received goods/services will be deemed undamaged and intact. The Buyer must carefully protect the goods/services after delivery. If the right of withdrawal will be exercised, the goods/services should not be used. The Invoice must also be returned with the Product.

RIGHT OF WITHDRAWAL:

The Buyer may exercise the right of withdrawal from the contract by rejecting the product without any legal or penal liability and without giving any reason, provided that they notify the SELLER through the contact information below within 14 (fourteen) days from the delivery date to themselves or the person/organization at the address they specified.

DURATION OF THE RIGHT OF WITHDRAWAL:

If the product is a service, the 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the service performance has started with the consumer's approval before the end of the withdrawal period.

The expenses arising from the exercise of the right of withdrawal shall be borne by the SELLER.

In order to exercise the right of withdrawal, it is necessary to submit a written notification to the SELLER by registered mail, fax, or email within 14 (fourteen) days and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Used" stipulated in this agreement.

EXERCISING THE RIGHT OF WITHDRAWAL:

The invoice of the product delivered to the third party or the BUYER must be returned, (If the invoice of the product to be returned is corporate, it must be returned with the return invoice issued by the institution during the return. If the order returns for corporate orders where the invoice is issued to the institution are completed without the RETURN INVOICE, they will not be completed.)

The return form, along with the boxes, packaging, if any, standard accessories of the products to be returned must be delivered complete and undamaged.

RETURN CONDITIONS:

The SELLER is obliged to refund the total amount and the documents that put the BUYER under debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notice and to take back the goods within 20 days.

If there is a decrease in the value of the goods due to the fault of the BUYER or if it becomes impossible to return the goods, the BUYER is obliged to compensate for the damages of the SELLER in proportion to the fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the product or goods within the withdrawal period.

If the campaign limit amount arranged by the SELLER due to the exercise of the right of withdrawal falls below, the discount amount benefited within the scope of the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

Products prepared according to the consumer's requests or explicitly personalized, underwear bottom parts, swimsuits and bikini bottoms, makeup materials, disposable products, products with a risk of rapid deterioration or whose expiration date may pass, products that are not suitable to be returned for health and hygiene reasons once delivered after the packaging is opened by the BUYER, mixed with other products after delivery and cannot be separated due to their nature, except for those provided under subscription contracts, periodicals such as newspapers and magazines, electronically performed services or intangible goods delivered instantly to the consumer, sound or image recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, cannot be returned if the packaging is opened by the BUYER according to the Regulation. Also, it is not possible to exercise the right of withdrawal for services whose performance has begun with the approval of the consumer before the end of the withdrawal period according to the Regulation.

Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be returned unopened, untested, undamaged, and unused to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES

In the event that the BUYER defaults on the payment transactions made by credit card, the BUYER acknowledges, declares, and undertakes that they will pay interest within the framework of the credit card agreement between them and the cardholder bank and be liable to the bank. In this case, the relevant bank may apply to legal remedies; it can demand the expenses incurred and the attorney's fee from the BUYER and in any case, if the BUYER defaults on the debt, the BUYER accepts to pay the damages incurred by the SELLER due to the delayed performance of the debt.
